Terms of Service

These terms explain the rules for using Visaprep Agent, the limits of AI-generated guidance, and the billing and account conditions that apply to users worldwide.

Before using Visaprep Agent, please review these terms carefully. They are especially important if you rely on mock-interview feedback, upload visa documents, or purchase a subscription.

1. Your relationship with Visaprep Agent

These Terms of Service govern your access to and use of Visaprep Agent, a service operated by Datamitra LLC, including our websites, apps, mock-interview tools, AI coaching features, billing flows, and related support services.

By creating an account, accessing the service, or purchasing a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and account responsibilities

  • You must be at least 18 years old or the age of digital majority required by the law that applies to you.
  • You must provide accurate information, keep your credentials confidential, and promptly notify us if you believe your account has been compromised.
  • If you use the service on behalf of a company, school, or agency, you represent that you are authorized to bind that organization to these Terms.
  • You may not use the service if doing so would violate sanctions, export controls, or other laws that apply to you or your organization.

3. Important service limits

Visaprep Agent offers educational, organizational, and practice tools only. It is not a law firm, not an immigration consultancy, and not a government service.

Nothing in the service is legal advice, immigration advice, or a guarantee of eligibility, interview approval, or any other government decision. There is no guarantee of a visa outcome, even if you follow the coaching guidance exactly.

You are responsible for reviewing official government instructions, verifying deadlines and form requirements, and deciding whether to consult a qualified attorney or licensed professional.

AI-generated suggestions can be incomplete, outdated, or wrong. Human review is always required before you rely on any output for a real application or interview.

4. Acceptable use and prohibited conduct

  • Do not use the service for unlawful, fraudulent, abusive, harassing, or deceptive activity.
  • Do not upload content that you do not own or have permission to use, including confidential documents about another person without proper authority.
  • Do not attempt to reverse engineer, probe, disrupt, overload, or bypass security features of the service.
  • Do not use the service to build competing models or automated extraction systems, or to create harmful, discriminatory, or misleading output.
  • Do not represent Visaprep Agent output as guaranteed legal advice or official government guidance.

5. Your content and permissions

You keep ownership of the materials you submit to the service, such as text, recordings, notes, and uploaded documents. You give us a limited license to host, process, transmit, and analyze that content only as needed to operate, secure, and improve the service in line with our Privacy Policy.

If your content includes information about another person, you are responsible for providing any notice and obtaining any permissions required by applicable law.

6. AI outputs and third-party services

  • Some features rely on third-party infrastructure, including Supabase for authentication and storage, Stripe/PayPal for payments, LiveKit for live voice sessions, and Google/OpenAI providers for AI coaching responses.
  • Outputs may be similar for different users and may contain mistakes, omissions, or inappropriate content. You must evaluate whether any output is suitable for your circumstances.
  • Third-party services may have their own terms and privacy notices, and your use of those integrated services may also be subject to those separate rules.

7. Intellectual property and feedback

  • Visaprep Agent, its interface, branding, software, and related materials are owned by us or our licensors and are protected by applicable intellectual-property laws.
  • You may not copy, resell, redistribute, reverse engineer, or create derivative commercial services from the platform except as expressly allowed by law or by our written permission.
  • If you send suggestions, reviews, or feature ideas, you allow us to use that feedback without restriction or compensation, unless applicable law says otherwise.

8. Subscriptions, billing, and refunds

Paid plans may renew automatically on the billing cycle shown at checkout unless you cancel before the next renewal date. Pricing, taxes, and available payment methods may vary by country or platform.

Refund and cancellation requests are allowed within 7 days from the exact date and time of purchase only if the service has never been used. Once any paid service usage has started, no refund will be issued except where required by applicable law.

If you believe you were billed in error, contact Datamitra LLC promptly at datamitra@outlook.com so that we can review the issue.

You remain responsible for any internet, telecom, banking, currency-conversion, or government fees connected to your use of the service or your visa process.

9. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, failed to pay required fees, or if continuing the service would create legal or security issues.

Sections that are meant to survive termination, including payment obligations, disclaimers, limitations of liability, and dispute provisions, will continue to apply after your access ends.

10. Disclaimers and limitation of liability

The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, secure, or suitable for every immigration scenario or jurisdiction.

To the fullest extent permitted by law, Visaprep Agent and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or losses caused by reliance on AI output or by government, embassy, or consular decisions.

If the law allows us to limit our total liability, that total liability will not exceed the greater of the amount you paid us for the relevant service during the 12 months before the claim or US$100.

11. Disputes, governing law, and local rights

  • We encourage users to contact support first so that concerns can be reviewed and, where possible, resolved informally before formal legal action is started.
  • Except where mandatory local law provides otherwise, these Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
  • If a court with proper authority decides that one part of these Terms is unenforceable, the remaining sections will continue to apply to the fullest extent permitted by law.

12. Global compliance, changes, and contact

  • These Terms are intended to operate globally, but some jurisdictions give consumers non-waivable rights. Nothing in these Terms limits rights that cannot legally be excluded.
  • We may update these Terms from time to time. If material changes are made, we will update the effective date and provide additional notice where required.
